I have yet to work with a family office that does not have AI tools running somewhere in its operations. Investment research, meeting transcription, document drafting, portfolio commentary. The tools are capable, the staff is using them and in most cases no one has formally reviewed, approved or documented any of it.

That independence is a strength in most contexts. But when something goes wrong with an undocumented AI decision, it becomes the problem.

No Examiner Does Not Mean No Accountability

Most family offices are not RIAs. Most do not answer to FINRA. But light regulation does not mean light accountability. It means the accountability runs in a different direction. When an examiner is not coming, the people who do come are beneficiaries, co-investors, counterparties and eventually courts. None of them need a regulatory violation to make a claim. They need evidence that a decision was made imprudently.

Beneficiary disputes require an unhappy beneficiary, a lawyer and a principal who cannot produce documentation of how a consequential decision was made. A principal who relied on an AI tool to support an investment recommendation, a distribution analysis or an estate planning review, and who has no record of how that tool was selected or what it contributed, has very limited ground to stand on. The absence of a rule requiring documentation is not a defense.

Co-investors and institutional counterparties are asking their own questions. Due diligence on family offices has grown more rigorous, and AI governance has become a standard line of inquiry. A family office that cannot describe its AI use coherently is creating doubt in relationships where doubt is costly.

The Data At Risk Is Different Here

Your staff is entering data into AI tools that you have not reviewed. I say this without qualification because I have not found a family office where it is not true. What data? Estate plans. Trust structures. Entity ownership charts. Liquidity event timelines. Family member financial details. Private investment terms.

This is among the most sensitive information that exists, and it is flowing into consumer AI platforms that were not designed to meet the confidentiality standards this data requires. Consumer AI tools frequently use inputted data to train their models. Most family offices have not asked whether their vendors have those agreements in place to prohibit that.

The trusted nature of the family office team creates exposure. Staff members who have worked closely with the family for years adopt new tools informally and without concern, because trust is the assumption. That trust is well-placed interpersonally. It does not extend to AI vendors.

The Principal Is The Governance Program

In a large RIA or broker-dealer, AI governance is distributed across functions. Compliance owns the policy. IT owns the inventory. Operations owns the vendor review. The principal sets direction and holds the functions accountable.

In most family offices, none of those functions exist as separate disciplines. The principal serves as both compliance and strategy, and also conducts the vendor review. That works in stable operating conditions. It breaks down when technology is moving faster than one person can informally track.

The staff member using an AI transcription tool is not trying to create a problem. The analyst drafting investment memos with a large language model is solving a real workflow challenge. But without a framework that captures what they are doing, the principal has no visibility into the risk being taken on the organization’s behalf.

That is not a technology problem. It is a governance problem.

Five Things To Build

The goal is not a compliance program. It is a defensible decision-making process that can be explained to a counterparty, a beneficiary or a court.

1. AI Tool Inventory. Know every tool in use across the family office, including tools used informally by staff. The inventory should capture the vendor, the use case, the categories of family and entity data involved, and when the tool entered the workflow.

2.  Written AI Acceptable Use Policy. This policy defines what tools are approved, what is prohibited and what requires review before use. It should specify which categories of data may and may not be processed by AI systems, with explicit attention to the data categories that carry the most exposure: beneficiary information, trust and entity structures, estate planning materials and investment terms.

3.  Vendor Security Review. For every AI tool that touches family or entity data, a documented review of the vendor’s data handling practices, retention policies and training data policies is needed. The specific question that matters most: Does this vendor use your data to train its models? The answer should be in writing, confirmed with the vendor directly and filed where it can be produced if the question is ever asked.

4.  Decision Documentation, which comprises any consequential decision supported by an AI tool, a record of what the tool contributed, what the principal reviewed and what judgment was ultimately exercised. The documentation does not need to be elaborate. It needs to demonstrate that AI supported a human decision rather than replaced it.

5.  Annual Review. The tool inventory, approved vendor list and policy should be reviewed at least once a year. New tools enter workflows informally and quickly. An annual review is how you find them before someone else does.

The Competitive Argument

Family offices compete for co-investment opportunities, institutional partnerships and access to managers who have choices about whose capital they accept. The due diligence on the other side of those relationships is thorough, and AI governance is an increasingly standard line of questioning.
